Implementation and Construction of International Law on Genetic Resources

Abstract: Implementation and Construction of International Law on Genetic Resources, published by the Intellectual Property Publishing House in December 2022, is the “companion book” of A Study of International Law on Genetic Resources published by Professor Zhang Xiaoyong in 2017. This book adopts research methods such as empirical research, logic analysis of laws, and comparative analysis of rules to conduct in-depth and detailed introduction, analysis and comments on the implementation of the Nagoya Protocol and the International Treaty on Plant Genetic Resources for Food and Agriculture, as well as the access and benefit sharing of marine genetic resources in areas beyond national jurisdiction, and the negotiation and construction of international legal rules. Meanwhile, based on China’s current situation and actual needs and adequate demonstration of relevant reasons, practical suggestions are put forward for China’s different measures, including legislation, law amendments, negotiations and preparations for future implementation. As the Kunming-Montreal Global Biodiversity Framework was adopted by the 15th Conference of the Parties (COP15) to the United Nations Convention on Biological Diversity (CBD), this book will also provide more unique and comprehensive perspectives for promoting the conservation of biological genetic resources diversity.
